The Demise of the 28-Clause Peace Initiative for Ukraine: Why Peace Negotiations Continue to Stumble

Europe experienced widespread relief on Monday, as the tension triggered by the introduction of a new 28-article proposal for ending the war appeared – briefly – to have been contained. A Washington representative spoke of "notable headway" after bilateral negotiations in Geneva. On Monday night, Russian leadership made its countermove: a renewed assault of missile and drone strikes on Kyiv.

The Pattern of Diplomacy and Destruction

The sequence of conflicting incidents captured the grim essence of the outgoing year. By day, diplomatic battles are fought: positive announcements are released from various governments. Considerable effort is devoted on restraining particular approaches. By night, the Kremlin forcefully demonstrates the world that, for them, conflict continues to be the key method for achieving "resolution".

Nocturnal Warfare

As military strikes developed into the early hours of Tuesday, the present situation of Ukraine's vulnerability was revealed. Ukraine is capable of detecting missile launches from Russian territory, a capability enabled by up-to-date information. From observation points, military aircraft that had been deployed to engage hostile cruise missiles streaked across the sky – sophisticated military planes delivered to Ukraine by Western partners.

Shortly after, Kyiv's air-defence systems engaged: defensive missiles fired to intercept a incoming threat. This was a modern interception technology at work, probably delivered by Western nations. Every launch creates sudden vibrations, rattling buildings. The instant of fear quickly transforms into resigned acknowledgment: possibly the hostile projectile won't cause damage this time, preventing destruction from ruin and further power outages.

Ongoing Risks

Soon after, a automatic firearm engaged a drone close by, part of a rapid response unit – probably allied-provided weaponry. Regrettably, the bullets missed the enemy aircraft – it continued its flight toward its destination.

Intermittently, this continued until dawn. Kyiv faced the early updates: seven people killed, devastation and utility failures in multiple buildings as a result of the evening attack. As typically, everyone still continued their routines – living the war. But those full day encapsulated Ukraine's essential dependence on Western support – a reliance that regional partners are clearly incapable to fill in the near term.

Ineffective Peace Efforts

The comprehensive proposal from Washington sparked intense emotion, debate and deep concern – and briefly redirected concern from Ukraine's major integrity crisis in years. Yet, we have seen this script before, after previous diplomatic encounters and international summits.

Every new approach from US leadership adheres to the consistent cycle: a political offensive against Ukraine, which Kyiv, with partner nations, effectively counters. They stabilise the situation but never actually secure success. This trend will, no doubt, persist.

Strategic Calculations

It is easy to blame particular leaders of consistently pushing Kremlin's demands. But that does not seem to be the whole story. US administration operates on a assumption understood by seasoned negotiators: you cannot win at the negotiating table what you have been unable to protect through force. The White House assumes that it is unrealistic to force Russia to relinquish the land that it presently holds in Ukraine's south or east.

The challenge is that while acknowledging this situation, Washington does little to deter Moscow, through statements or actions, from assuming that the current condition will not shift further in its favour in the near future.

Opposing Positions

Therefore, Moscow is confident that the clock favors them – that Ukraine and its partners are coming close to fatigue. Their incentive to agree to terms that does not give them the greatest potential benefit is close to zero. There may be multiple initiatives to achieve ceasefire, but they will persist as long as Russia's leader remains highly assured in the outcome.

On the contrary, Ukraine's government believes that Ukraine can still endure, slowly losing people and territory but preventing a complete military breakdown until situations evolve in its advantage.

Current Realities

Factually, there are no actual prerequisites for a ceasefire. Now, subjective factors are coming into play: leadership ambitions to mediate resolution and achieve global acclaim, and the government's dual difficulties – on one hand, not to distance important partners, and on the other, to unite the population around the flag against any initiative Kyiv finds unworkable, so that their attention does not switch to domestic problems. And although their objective will now be significantly challenging after current events, it remains highly unlikely that this will alter their fundamental strategy.

These two forces are influencing discussions.

Assessment and Future

It took a just a single week to terminate the proposed articles of the latest plan. Assertive and inconsistent approach of the matter by Washington, opposition by Ukraine and the other European countries, along with pacifying measures of representatives, and finally, recent disclosures, all served their function.

While new proposals based on old ideas are imminent, Kyiv, London and other European capitals should reach an essential realization: Ukraine and Europe will only be able to counter negotiation assaults from Washington that are founded on Moscow's terms and reflect certain reluctance to change the course of events, if they maintain solidarity and strengthen their defence capabilities at a significantly accelerated rate. If they do, neither political nor armed coercion will be able to overcome them. In the meantime, Ukraine's capability to counter nocturnal attacks will, for the foreseeable future, primarily depend on continued Western support.
